GENERAL TERMS AND CONDITIONS
1) General The website www.bolidster.com is administered by the company Motocycle Armored Denim PROJECT SAS, otherwise called in these Terms of Sale M.A.D. Project, registered in the Register of Commerce and Companies under No. 819 291 873 R.C.S. Bayonne, whose headquarters is Technopole Izarbel – 97 Allée Théodore Monod 64210 Bidart.
By purchasing and accepting the delivery of products provided by M.A.D. Project (the “Products”) through the site www.bolidster.com, the customer, natural person, excluding legal persons (the “Customer”), agrees to be bound by these terms and conditions of sale. These general conditions of sale will apply if accepted by the customer, electronically or via an agreement signed with M.A.D. Project, at this product sale.
M.A.D. Project reserves the right to modify these general conditions of sale at any time and in its sole discretion. The modified terms will apply to any new offer and order, without regard to the previous relationship between M.A.D. Project and the Client.
Subject to proof to the contrary, the data recorded on the website www.bolidster.com establish the proof of all the transactions between M.A.D. Project and the Client.
2) Orders and means of payment
PLACEMENT OF AN ORDER
2.1. All orders are made on the website www.bolidster.com.
2.2. The Customer checks the details of the order and the price to be paid, and corrects any errors before confirming the order (the “Order Confirmation”). This Order Confirmation represents the validation of the order by M.A.D. Project, subject to the actual payment of the purchase by the Consumer. The conditions applicable to an offer may be modified as long as the customer has not confirmed his order.
2.3. M.A.D. Project reserves the right to change the applicable prices of the Products at any time. The price to be paid by the Consumer for the purchase of the Product will be the price mentioned in the Order Confirmation made by the Customer according to the prices in effect on the website of M.A.D. Project and according to the shipping costs indicated in the basket of purchase before validation at the time of the placing of the Order. The price indicated in our Confirmation of order is the final price expressed in Euros, all taxes included at the legal rate in force. It also includes the delivery costs borne by the Customer.
2.4. M.A.D. Project will send the Customer an acknowledgment of receipt of the order electronically.
2.5. Invalid information provided by the Customer will result in delays in processing the order. M.A.D. Project will not be liable to Customer for such delays.
STOCK LIMIT AND FRAUD CONTROL
2.6. The Customer acknowledges that the Products offered for sale are subject to the limits of available stocks.
2.7. If a Product is no longer available in the stocks of M.A.D. Project, M.A.D. Project will make its best efforts to inform the Customer of such unavailability prior to the Order Confirmation.
2.8If a Product is no longer available in the stocks of M.A.D. Project, the Customer may nevertheless place an Order to reserve a Product. M.A.D Project centralizes all the information concerning the estimates of delivery date of the ordered products, from the page: Reservations.
2.9. M.A.D. Project also reserves the right to cancel or refuse any order in case of incomplete order made by the Customer when registering information on the Web Store of M.A.D. Project (for example: unreadable order, lack of essential information, …), or, in the case of an order made by an insolvent Customer or with whom there were previous payment problems or a dispute as part of an order former. In this case, an email will be sent to the Customer. To avoid any attempt of fraud, M.A.D. Project reserves the right to (i) request additional information from a Customer and / or (ii) limit an abnormally high amount of Products ordered.
2.10. Thus, the receipt of an order does not automatically lead to its acceptance by M.A.D. Project. M.A.D. Project reserves the right to limit the quantity of Products ordered and the right to refuse to sell Products to any Customer in accordance with the provisions mentioned above. If an order can not be made or canceled by M.A.D. Project, M.A.D. Project will send a notification to the Customer using the email address provided by the Customer. The Customer will not be charged if his order has been canceled or can not be done by M.A.D. Project. If the Customer has already been billed for an order that is subsequently canceled or can not be made, M.A.D. Project will fully reimburse the amounts paid by the Client.
2.11 Only one means of payment is possible for the purchase of Products made on our online site: the payment via Paypal. The debit is made at the time of the validation of the order. M.A.D. Project will not send any Products until the payment method has been validated.
The list of means of payment may be subject to change by M.A.D. Project.3) Delivery and Return of Products.
3.1. M.A.D. Project accepts order deliveries in the vast majority of territories. The list of eligible countries will be subject to change by M.A.D. Project. Orders to countries not included in the list can be made by M.A.D. Project on a case by case basis. Import fees may be requested for customs clearance directly to the Customer.
DELIVERY OF PRODUCTS
3.2. A delivery will be made in respect of an indicative delivery date as stated in the Order Confirmation (according to the carrier responsible for the delivery and the location of the Customer), unless an event outside the control of M.A.D. Project. In such a case, if M.A.D. Project is unable to meet the estimated delivery date, M.A.D. Project will contact the Client with a revised evaluated delivery date.
3.3. The delivery will be completed once the Products delivered to the delivery address indicated by the Customer by the carrier under its sole responsibility.
3.4. If no one is available at the Customer’s address to receive the delivery, the carrier proposed by M.A.D. Project will leave a card informing that the Products have been returned to their local depot. If a Product is returned to the depot, the Customer will contact the carrier to arrange for a new delivery date using the details of the card.
DUTY OF CUSTOMER
3.5. If the Customer fails to receive the Product or accept the delivery within the time of their availability, as communicated by the carrier or M.A.D. Project (at a deposit for example), M.A.D. Project reserves the right to terminate the order and subsequently refund the Customer and resell the Product, unless the Client has notified to M.A.D. Project its willingness to arrange a new delivery.
3.6. Despite the legal warranties attached to any Product based on applicable law, the Customer will verify the conformity of the delivered Product with regard to the Order Confirmation.
3.7. Therefore, if the Product or the packaging of the Product is damaged at the time of delivery or in the event of non-compliance of the Product with the Customer’s Order Confirmation, it is the Customer’s sole responsibility to decline the delivery. .

3.9. Any Product damaged during shipment or non-compliant with the Order Confirmation and which Customer has refused delivery will be replaced or refunded by M.A.D. Project at no additional cost. Any damaged product returns will be made through the Customer Service of M.A.D. Project and / or, in any case, according to the instructions and requirements of M.A.D. Project, despite clause 5.5 of these Terms and Conditions.
3.10. If the Customer fails to decline delivery of a damaged or non-conforming Product or damaged packaging within five (5) days, the replacement or refund of the Product will be at the discretion of M.A.D. Project and could incur costs for the Client.
4) Property and risk: PROPERTY RIGHTS
4.1. Unless otherwise stated in writing by M.A.D. Project, the ownership of the Products will be transferred to the Customer when all amounts owed by the Client to M.A.D. Project will be paid. M.A.D. Project reserves the right to take back Products at the expense of the Customer or suspend a delivery in case of default of a full payment.
4.2. The Products will be the property of the Customer only after full payment has been received by M.A.D. Project, including all applicable delivery charges.
4.3. The risk of loss will be transferred to the Customer upon delivery of the Products to the delivery address set out in the Order Confirmation.
EXCHANGE AND RETURN OF PRODUCTS
4.4. Any request for product replacement must be initiated within 14 days after receipt of your order by a written request by sending an email to email@example.com or by sending a request by mail to:

4.5. The return address of the product, as well as the reference of the replacement file will be provided by replying the replacement request letter.
4.6. Returned items must be new, unused and in their original condition otherwise they will not be accepted and returned to you.
4.7. If you want an exchange of your products, transportation costs for the return home from you to MAD Project will be at your discretion. MAD Project will cover the cost of returning replacement jeans to your attention. Inside the package, the Customer will clearly indicate the reference of the replacement file.
4.8. Your exchange will be processed within 3 to 5 business days of receipt of the package.
4.9. If you want to return your products. Your return will be processed within 3 to 5 working days after receipt of the package
4.10. In the case of an exchange request for a size problem, MAD undertakes to do everything possible to replace the returned product in the size requested by the Customer. However, in case of unavailability of the size requested at the reception at MAD of the returned product, MAD may have to delay the exchange pending a restocking. For products whose production is no longer ensured in restocking, MAD may refuse the exchange. In the case of a refusal of the exchange, the product will be returned as is to the customer.
5) Right of withdrawal:

5.1. The Customer, if residing in the European Union, has a legal right to withdraw from any contract of sale for any reason within fourteen (14) calendar days, starting on the day of the receipt of the Product. If the Customer decides to arrange the shipment by himself, it is his responsibility to arrange the shipment, prepay any charges related to the return of delivery, including Customs Duties, to ensure shipment or to accept the risk in the event of Products damaged or lost during transit. In case of lost / damaged shipment, it is the Customer’s responsibility to resolve the problem directly with the carrier. In addition, the Customer has a legal obligation to provide reasonable care to the Products while in their possession or custody.
5.6. The price paid for the Products by the Customer may be reimbursed by M.A.D. Project. If the Customer wants a full refund, it will be made in the form of vouchers. If the Customer wishes to be reimbursed by other means, the order processing fees assumed by MAD Project for the performance of the initial service performed (packaging, delivery, and return processing) will be deducted. A fixed amount of € 25 will be deducted per returned product. In the case of a purchase having benefited from a special rate thanks to a promotional code, the refund will be made entirely in purchase vouchers. Return delivery charges, customs duties are left to the expenses of the Customer.
5.7. Any refund will be processed by M.A.D. Project as soon as possible and in any case, no later than thirty (30) days from the date on which the Customer has expressed his right of withdrawal.
6) Force majeure:
M.A.D. Project will not be responsible for or liable for any loss or damage incurred by the Customer as a result of causes beyond the reasonable control of M.A.D. Project, including, but without limitation, war, invasion, insurrection, riot, order of a civilian or military authority, fire, natural disasters. Customer’s acceptance of the delivery of the Products will or will be deemed a waiver of all complaints against M.A.D. Project for loss or damage caused due to any delay.
7.1 Despite any legal warranty attached to any Product based on applicable legal rules, M.A.D. 8) Limitation of liability of M.A.D. Project:

10) Applicable law:
